In Greene County district court Amber Marie Benavides, 25, of Grand Junction was sentenced to two days in jail after she changed her plea to guilty to a charge of operating while intoxicated- first offense. She must pay a sheriff’s room and board fee for the time she serves. She must complete the recommendations of a substance abuse evaluation she has already undergone and she must complete a community college drinking drivers school. She may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of the jail time and the drinking drivers school.
Benavides was fined $1250 with a $437.50 surcharge and a $10 surcharge for drug abuse resistance education (DARE). She must pay $600 restitution for her court appointed attorney’s fees and $100 court costs. Charges against Benavides in magistrate court of interference with official acts and disorderly conduct were dismissed with no court costs assessed against her. (Sentencing: Honorable Joseph B. Joshuah Jay Blumberg, 22, of Farlin was sentenced to two years in prison July 17 after he changed his plea to guilty to a charge of driving while license barred. The prison term was suspended and he was placed on informal probation for two years. Blumberg was fined $625 with a $218.75 surcharge; both were suspended. He must pay $600 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)
Michelle Nicole Howard, 23, of Boxholm was fined 4200 with a $70 surcharge after she pleaded guilty to a charge of disorderly conduct, amended from OWI- first offense and possession of a controlled substance. She must also pay $300 restitution for her court appointed attorney’s fees and $60 court costs. Judge McCarville also entered a judgment in a magistrate case against Howard in which she was charged with criminal mischief- fifth degree. She was fined $200 with a $70 surcharge. Court costs in that case were $60.
Johnnie Adam Jackson, 55, of Linden was sentenced to five years in prison after he pleaded guilty to a charge of burglary- third degree. The prison term was suspended and he was placed on probation for two years. He was fined $750 with a $262.50 surcharge; both were suspended. He must pay a $125 LEI surcharge, $807.35 victim restitution, and $929.45 court costs. The judge found him unable to pay restitution for his court appointed attorney’s fees. Charges of theft- fourth degree and criminal mischief- third degree were dismissed. (Sentencing: McCarville)
Ryan Michael Vaughn, 27, of Farnhamville was granted a deferred judgment after he pleaded guilty at arraignment to a charge of OWI- first offense. He must complete a community college drinking drivers school and he will be on informal probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He must pay a $1,250 civil penalty; one-half will be waived if he attains a temporary restricted license. Court costs were $100. A charge of possession of marijuana was dismissed. A magistrate case in which Vaughn was charged with possession of drug paraphernalia was also dismissed. (Sentencing: McCarville)
Riley Isaiah Walstrom, 23, of Jefferson pleaded not guilty to a charge of burglary- third degree. A trial date was set for Sept. 25.
Information is available since the return of an arrest warrant that Dean Paul Hearn, 65, of Otho has been charged with criminal mischief- second degree. The warrant was issued March 5 and returned July 10.
Cases were initiated in district court as follows: Jeng Vang, 36, of Denison, driving while license barred; and Malissa Lou Brooks, 40, of Ames, possession of marijuana- third or subsequent offense.
